Calling support for law on intersex protection in Thailand

As we celebrate the first anniversary of the Draft Law “Self-Determination of GIESC” on Intersex Awareness Day, Intersex Thailand is ready to push for another draft law to recognize the self-determination of gender identity, gender expression, and sex characteristics of persons. The intersex community presented this draft to the Parliament of Thailand.

October 26th of every year is observed as International Day for Intersex Awareness. In 2022, during the third Asian Intersex Forum held at Sukosol Hotel in Bangkok, Ms. Nada Chaiyajit, co-founder of the Intersex Thailand organization, presented the draft bill to recognize the determination of gender identity, gender expression, and sex characteristics of a person, known as B.E. … or “The Self-Determination of Gender Identity, Gender Expression, and Sex Characteristics Act B.E. …” This allows intersex people to define their gender identity as transgender, non-binary, or retain their own intersex identity while exercising their right to determine their gender and gender marker according to their wishes.

Currently, there are three draft laws regarding recognising gender identity and sex characteristics of individuals. Only the draft from the GEN-ACT Committee has already been submitted to Parliament, and it is ahead of the draft bill from the Department of Women’s Affairs and Family Institutions at the Ministry of Social Development and Human Security. However, to ensure that the intersex community is an active participant in enacting laws relevant to their identities and ways of life, it is necessary to draft an additional fourth law. This will promote participation from the public sector and stakeholders, leading to a more diverse set of ideas and legal principles. Ultimately, Thailand will have a law that recognizes and protects gender identity and sex characteristics consistent with international human rights standards and obligations to which Thailand is a party. 

Therefore, on Intersex Awareness Day, which falls on October 26, 2023, Intersex Thailand and Intersex Asia would like to present this draft law to the public and are ready to submit it to the House of Representatives for approval. We aim to continue the process of gathering input, in line with the Constitution, and we sincerely hope that our voices will be as meaningful as the voices of other LGBT communities in Thailand.

ทุกวันที่ 26 ตุลาคม ของทุกปีถือเป็นวันสากลเพื่อการตระหนักรู้ตัวตนของบุคคลอินเตอร์เซ็กส์ ในปี พ.ศ.2565 ระหว่างงานประชุมสัมมนาระดับภูมิภาคขององค์กร Intersex Asia ครั้งที่ 3 ซึ่งจัดขึ้น ณ โรงแรมสุโกศล กรุงเทพ คุณนาดา ไชยจิตต์ผู้ร่วมก่อตั้งองค์กร Intersex Thailand ได้นำเสนอร่าง ร่างพระราชบัญญัติรับรองการกำหนดเจตจำนงในอัตลักษณ์ทางเพศสภาพ การแสดงออกทางเพศสภาพ และคุณลักษณะทางเพศของบุคคล พ.ศ. … หรือ “The Self Determination of Gender Identity, Gender Expression, and Sex Characteristics ACT B.E. … ” เพื่อให้บุคคลอินเตอร์เซ็กส์ที่นิยามตัวตนทางเพศเป็นบุคคลข้ามเพศก็ดี หรือนอนไบนารีก็ดี หรือแม้จะดำรงไว้ซึ่งอัตลักษณ์ความเป็นอินเตอร์เซ็กส์ของตัวเองก็ดีได้ใช้สิทธิในการกำหนดเจตจำนงเลือก “เพศ” และ “เครื่องหมายระบุเพศ” ตามความประสงค์ของเจ้าตัว 

ปัจจุบันมีร่างกฎหมายที่เกี่ยวของกับการรับรองอัตลักษณ์ทางเพศสภาพและคุณลักษณะทางเพศของบุคคลแล้วจำนวน 3 ร่าง ได้แค่ร่างของ คณะกรรมการ GEN-ACT ซึ่งได้ยื่นต่อรัฐสภาเป็นที่เรียบร้อยแล้ว และร่างกฎหมายของพรรคก้าวไกลกับร่างกฎหมายของกรมกิจการสตรีและสถาบันครอบครัว กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ อย่างไรก็ตาม เพื่อทำให้แน่ใจได้ว่าชุมชนอินเตอร์เซ็กส์จะได้เป็นผู้มีส่วนร่วมในกระบวนการนิติบัญญัติตัวบทกฎหมายที่เกี่ยวข้องกับตัวตนและวิถีชีวิตของตัวเอง จึงจำเป็นอย่างยิ่งที่จะต้องมีร่างกฎหมายเพิ่มเติมเป็นร่างที่ 4 เพื่อส่งเสริมการมีส่วนร่วมของภาคประชาชนและผู้มีส่วนได้ส่วนเสียมีส่วนร่วมในการออกกฎหมายอย่างมีนัยยะสำคัญและเพิ่มความหลากหลายทางแนวคิด หลักกฎหมาย เพื่อให้ท้ายที่สุดแล้ว ประเทศไทยจะได้มีกฎหมายรับรอง คุ้มครอง อัตลักษณ์ทางเพศสภาพ และ คุณลักษณะทางเพศที่สอดคล้องกับมาตรฐานและพันธกรณีด้านสิทธิมนุษยชนสากลที่ประเทศไทยเองเข้าร่วมเป็นภาคี

ดังนั้นในวันตระหนักรู้ตัวตนของบุคคลอินเตอร์เซ็กส์ หรือ Intersex Awareness Day ซึ่งตรงกับที่ 26 ตุลาคม 2566 นี้ องค์กร Intersex Thailand และ Intersex Asia ขอนำเสนอร่างกฎหมายฉบับดังกล่าวนี้ต่อสาธารณชนและพร้อมผลักดันยื่นต่อสภาผู้แทนราษฎรเพื่อเข้าสู่กระบวนการรับฟังความคิดตามรัฐธรรมนูญต่อไป พวกเราหวังเป็นอย่างยิ่งกว่าเสียงของพวกเราจะมีความหมายไม่ยิ่งหย่อนไปกว่าเสียงของชุมชนความหลากหลายทางเพศอื่นๆในประเทศไทย
